When getting divorced, it is nearly impossible to anticipate everything that will need to be addressed. This is especially true if you got divorced when your children were little. You may have had a hard time envisioning them much beyond preschool. You shouldn’t be left to think of everything on your own. The right family law attorney will know the key issues that should be identified upfront to avoid future conflicts. This is especially true for college expenses.
I am Vanessa López Aguilera, an experienced Indianapolis family law attorney. For years, I have helped clients negotiate parenting plans that clearly outline expectations for each side. This can serve as a roadmap to mitigate the potential for conflicts in the future. I put my clients in touch with CPAs and financial planners to help them develop a plan around handling college expenses that makes sense.
Even if college expenses were not initially addressed when you got divorced, your child is not out of luck. In July 2012, a state law was passed requiring custodial parents or students to request contributions for college expenses from the non-custodial parent before the child turns 19. The money could be used to help cover:
After a child turns 19, a parent can no longer request college expense contributions from the other parent. In the past, a non-custodial parent or the student could request contributions up until the child turned 21. The new law encourages parents to plan ahead so their children can secure the money necessary to obtain a quality education. Once the student turns 19, the non-custody parent would no longer have to pay child support.
Our firm understands questions about your students’ futures and your financial situation can create anxiety. We can get you in touch. We are here to address any questions you might have about child support terminations and college expense calculations. We want to make sure you have the right information to plan for the future.
