How Is Child Support Determined?
As an Indianapolis, Indiana, child support lawyer, I am sensitive to the needs and concerns of my clients. If you are paying support, you want to make sure the amount was accurately determined and that you can afford paying it. If you are receiving child support, you want to feel comfortable with the amount you are receiving.
Both parents are required to support their children. In Indiana, child support is determined by a statutory calculation. Factors that are used in the calculation include:
- Each parent's income
- Number of children
- Number of overnights with the noncustodial parent
Additionally, there is a presumption that both parents will contribute to college expenses. I have extensive experience guiding fathers and mothers through the divorce process. You can feel confident knowing I will make sure child support calculations are based on accurate numbers so you will not be taken advantage of.
Child Support Can Be Modified and Enforced
The months and years after a divorce can bring significant change. If there has been a substantial increase or decrease in income, a modification to the existing child support order can be granted. A child custody modification can also cause the amount of child support you pay or receive to be modified.
If your ex-spouse is not paying child support, you can go to court to seek a child support enforcement. If your ex-spouse is found in contempt, the judge can force him or her to pay your attorney's fees. I am an aggressive advocate committed to protecting you and your children, whether you are seeking to enforce or modify the child support arrangement.
