Challenges Faced by LGBTQ+ Couples
LGBTQ+ couples in Indiana face some legal challenges not experienced by non-LGBTQ+ families, including statutory recognition of marriage, and domestic partnerships. By statute, Indiana only recognizes marriages between a man and a woman and denies this recognition to same-sex unions. There is also no recognition of domestic partnerships at the state level in Indiana. On June 25, 2014, a U.S. District Court judge declared same-sex marriage legal in Indiana, but a higher court put a stay on the ruling.
Title VII of the Civil Rights Act of 1964 prohibits employers from discriminating against any individual wit with respect to his compensation, terms, conditions, or privileges of employment on the basis of sex, race, religion, or nationality, and Indiana law offers further protection against discrimination, and same-sex activity is legal in the state.
Adoption Rights
Under Indiana law, single LGBTQ+ persons are permitted to adopt, and in 2006 the state Court of Appeals ruled that unmarried couples, including same-sex couples, may adopt as well, and some local courts have supported the right of a same-sex partner to adopt his or her same-sex partner’s biological or adopted child.
