Permanent Residency Assistance
Some Latinos arrive in the United States without inspection. Immigrants who arrive without inspection are sometimes called illegal aliens, but the term is vague and not appropriate. In reality, many Latinos immigrants are simply under-documented.
A lawyer can help you obtain the documentation for legal permanent residency and/or naturalization. However, until the United States has true immigration reform, it will likely be a lengthy, bureaucratic and difficult process. Family-Based Immigration
Marriage is still the fastest way to become a U.S. resident and obtain a "green card". However, not all family relationships serve as a basis for permanent residency and citizenship in the United States. The following summarizes who can apply for family-based immigration visas.
- Fiancé visa. The fiancé visa is for people who are coming to the United States to marry a U.S. citizen within 90 days after admission.
- Immediate relatives. Immediate relatives have first priority for family-based immigration. Immediate relatives include spouses of U.S. citizens, minor children of U.S. citizens, parents of U.S. citizens, spouses of deceased U.S. citizens and any children born after the issuance of a relative visa but before the visa is used for entry into the United States.
- Preference immigrants. After immediate relatives, first preference is given to unmarried sons or daughters of U.S. citizens; second preference is given to spouses or unmarried children of a foreign national lawfully admitted for permanent residence; third preference is given to married sons or daughters of U.S. citizens; and fourth preference is given to brothers or sisters of U.S. citizens. The spouse or child of the visa applicant is entitled to the same status and order of consideration as the applicant.
