Many different legal tools exist that members of same-sex couples can use to protect their rights under Indiana's family laws. Some of the most common LGBT family law issues I handle include:

  • Property agreements for domestic partnerships: Much like prenuptial agreements in a heterosexual marriage, a same-sex couple can use a property agreement to specify individual or joint ownership of certain assets or debt before entering into a domestic partnership.
  • Separation agreements: These are also similar to separation agreements for unmarried heterosexual couples. When a domestic partnership ends, a separation agreement may be used to formalize agreements about the division of property, partner financial support and child custody and parenting time.
  • Adoption: LGBT adoptions proceed in Indiana as single parent or second parent adoptions, depending on the factual circumstances of the family. I can help with the necessary paperwork, up to and including name changes on birth certificates.
  • Wills and guardianships: Because Indiana does not formally recognize civil unions, wills and guardianships are critically important for same-sex families to protect their rights to inherit from their partners, to make health care decisions on behalf of incapacitated partners, and to receive custody of any children of the partnership.
