Most people with serious debt problems pass the means test with advice from a bankruptcy lawyer. If your income is too high to file Chapter 7 bankruptcy, you can file Chapter 13 bankruptcy.
  • Chapter 7 bankruptcy. Filing Chapter 7 bankruptcy allows you to eliminate unsecured debts — things like credit card debts, hospital bills, payday loans and other debts that are not secured by property (such as your home and your car loans).
  • Chapter 13 bankruptcy. Filing Chapter 13 bankruptcy is a good option if you have significant assets such as a home that you would not be able to keep by filing Chapter 7 bankruptcy. Chapter 13 bankruptcy is a court-approved debt repayment plan that provides debt consolidation and debt reduction.
